All patients must complete the HIPAA Privacy Policy and Informed Consent forms when a new procedure is scheduled. Your contact information (email and/or phone) establishes your communication preferences and is essential for healthcare-related communications. These include pre-treatment verification of your health history, discussion of your care and treatment plan, post-procedural care instructions, and billing processes. By providing this contact information, you give both implied and explicit consent for healthcare-related communications.

Payment Processing: HIPAA Regulatory Exemptions

The HIPAA regulations contain a specific exemption for certain payment processing activities conducted by financial institutions. This means that in many cases, healthcare providers do not need to be concerned about HIPAA compliance when simply accepting credit card payments through standard processors.

The Exemption:

  • Is codified in 42 USC §1320d-8.
  • Excludes activities like authorizing, processing, clearing, settling, billing, transferring, reconciling, or collecting payments for healthcare or health plan premiums through various means such as credit/debit cards, checks, or electronic funds transfers.
  • Applies to entities engaged in activities of or acting on behalf of a financial institution for these specific payment activities.

Application of the HIPAA Regulatory Exemption to Patient Services

This exemption is based on the idea that financial institutions are providing normal banking services when processing healthcare payments, not performing a HIPAA-covered function. Generally, standard credit card processors are not considered business associates under HIPAA, and a Business Associate Agreement (BAA) is not required for these services because they primarily focus on card payment information and do not typically handle or transmit protected health information (PHI).

We use Stripe to process card payments. Please be advised that only names and email addresses are provided to Stripe and are used solely for payment processing activities as defined by the exemption outlined in this section of the Notice of Privacy Practices. No protected health information is shared with our payment processor.
